Terms of Use for Filmuy Paid Service
Terms of Use for Filmuy Paid Service defines the terms concerning the use of paid services provided by a service provider.
When you use the paid services, this " Terms of Use for Filmuy Paid Service " shall be applied. So please make sure to read before using this service.
In addition, when you use paid service, you need to agree to "Filmuy Terms of Use" and " Terms of Use Filmuy Paid Service " and paid registration is required. Please make sure to read it before using this service.
【Article 1 About Paid Service Terms of Use】
1. "Terms of Use Filmuy Paid Service " (hereinafter referred to as " Terms of Use for Filmuy Paid Service ") defines the conditions for using paid service (hereinafter referred to as "paid service") provided by the service provider. If you use the paid service, you shall be deemed to have agreed to the Terms of Service for Paid Service.
2. If the service provider determines that there is a probable cause, the service provider can change the service at anytime without obtaining the prior consent of the registrant who uses the paid service (hereinafter referred to as "paid user member") according to the judgment of the service provider.
3. The changed terms and use of paid services will become effective upon the time they are displayed on this site, except as otherwise provided by the service provider separately. If the paid user members use the paid service after the change of the terms of use for paid service becomes effective, they shall be deemed to agreed with the posted term of use for paid service.
【Article 2 Definition】
Terms used in the terms of use for Paid Service are the same as the terms of the Filmuy terms of use, except those specified in the following items.
1. "Video shop" is a website opened by Filmuy.
2. "Video shop administrators" are those who provide their own videos at the video shop and operate the video shop.
3. "Paid video" is a video that is sold at each video shop among paid services.
4. "Point" means a fixed amount of values that can be used for various services in Filmuy. Filmuy separately defines Filmuy’s service that points can be used.
【Article 3 Paid Registration】
1. When a user uses the paid service, paid registration is required.
2. Users wishing for paid registration must agree to the Filmuy terms of use and terms of use for paid service, and follow the registration procedures defined by the service provider.
3. The service provider shall conduct necessary review for the contents of the application (including the credit card number) entered according to the procedures defined in the preceding paragraph. When the paid user members can use the paid service, it shall be deemed that there was an intention to accept the application of the paid user member by service provider. In addition, when the content of the application is inappropriate as a result of reviewing the content of the application, the service provider may not approve the paid registration according to the judgment of the service provider.
【Article 4 Usage fee】
1. The usage fee of paid movies shall be determined separately by each video shop administrator.
2. The usage fee of point shall be determined separately by Filmuy.
3. Each video shop administrator and Filmuy may change the usage fee of the paid service without obtaining prior consent from the paid user. However, such change shall become effective in the future. In addition, if the paid user member does not agree with the change, the paid service will be canceled within the prescribed period. If the period expires without cancel, it shall be deemed that the paid user agreed with the change.
【Article 5 Settlement】
1. Payment of usage fee for paid service shall be made by settlement method defined by the service provider.
2. The service provider will not issue a receipt etc. about payment of usage fee of paid service.
【Article 6 Interest for delay】
1. When the paid service member does not pay usage fee and any debt of other service provider within prescribed period, the paid service member must pay the amount calculated at the rate of 14.6% per year in the number of the days from the next day of payment deadline to the payment date in lump sum with usage fee and debt of other services by the specified method and by the date defined by the service provider.
2. Transfer fee and other fee necessary for the previous paragraph shall be borne by paid user members.
【Article 7: Cancellation of Payment Registration】
1. When the paid service member cancels the paid service, the paid user member shall follow the cancellation procedure specified by the service provider, and with completion of the cancellation procedure, the paid use member is canceled from the use of the paid service.
2. In any case, the service provider will not refund any fee or any other fee that has already been received.
3. The paid user member shall pay the full amount of usage fee for the month even if the cancellation procedure of the paid service is done in the middle of the month.
【Article 8 Cancellation of paid registration, etc.】
1. When the service provider determines that the paid user member falls under any of the following, the service provider shall be able to suspend the paid service or cancel the paid registration without prior notice to the paid user member.
(1) When the service provider determines that the paid user member falls under any of the items of each paragraph of Filmuy terms of use Article 13.
(2) When usage fee of paid service and other debt are delayed or refuse to pay.
(3) When the settlement method is stopped.
(4) When the paid user member receives a provisional seizure, provisional disposition, compulsory execution, tax termination disposition. etc., a petition for commence of bankruptcy proceedings or a petition for commencement of civil rehabilitation proceedings. When the paid service member receives a trial on commence of guardianship, a trial for commencement of curatorship or an assistance.
(5) Where the service provider requested the resolution of a violation of the Filmuy terms of use and term of use for Filmuy paid service, the paid service member does not comply with the resolution.
2. When the paid user member falls under any of the items of the preceding paragraph, the paid service member shall lost the profit of the deadline and pay the usage fee of the paid service occurring at the time and any other debt for other service providers in a lump-sum.
3. When the service provider suffers damage due to each item of paragraph 1 of this Article, the paid user member, regardless of whether paid registration is canceled or not, the service provider shall be able to claim damage against the paid user member including those who have been cancelled from the paid registration.
4. The Service Provider shall not be responsible for any result caused by such measures when taking the measures prescribed in paragraph1 of this Article.
【Article 9 Handling of Personal Information】
1. The service provider shall handle the registration information of the paid user member appropriately based on the Filmuy terms of use and the "Personal Information Protection Policy" and "Handling of Personal Information" defined separately.
2. Regardless of the preceding paragraph, the service provider shall disclose personal information to credit card companies, etc., when necessary for identification of debt and credit, payment and collection. However, the service provider conducts it under strict control between third parties and service providers such as checking handling methods including disposal of information.
3. The paid user member shall approve the outsourcing contractor entrusted by the service provider to manage credit card information and other payment method in order to charge the paid service member for the usage fee of the paid use service.
